Terms of Service

These Terms of Service ("Terms") govern your access to and use of Draft Tally, including the website at drafttally.com and the application at app.drafttally.com (together, the "Service"). The Service is operated by Draft Tally ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who may use Draft Tally

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian. By using the Service you confirm that you meet these requirements and that the information you give us is accurate.

2. Your account

You need an account to use most of the Service. You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us promptly at support@drafttally.com if you believe your account has been accessed without your permission.

3. Price and support

Draft Tally is currently free to use. Voluntary contributions through Ko-fi are exactly that: voluntary. They are not a purchase, they do not buy additional features, and they are generally not refundable. If we ever introduce paid features, we will describe the price and terms clearly before you are asked to pay.

4. Your content

Everything you enter into Draft Tally, including project names, word counts, session notes, and any text you record, is your content and remains yours. We claim no ownership over it.

You grant us a limited licence to store, process, back up, and display your content solely so that we can operate the Service for you, for example by rendering your dashboard and generating your charts and streaks. This licence ends when you delete the content or your account, except for copies held in routine backups until those backups expire.

5. Acceptable use

You agree not to:

break the law or infringe anyone's rights while using the Service;
upload malware, or attempt to probe, scan, or breach the security of the Service;
access another user's account or data without permission;
interfere with or place an unreasonable load on our infrastructure, including through automated scraping or excessive requests;
resell, sublicense, or commercially redistribute the Service; or
reverse engineer the Service except where that right cannot be excluded by law.

6. Service availability and changes

We work to keep Draft Tally running, but the Service is provided on an as-available basis. We may change, suspend, or discontinue features at any time, and we may need to take the Service offline for maintenance. If we decide to discontinue the Service entirely, we will make a reasonable effort to notify registered users in advance so you can export your data.

7. Third-party services

Draft Tally relies on third parties to operate, including our application hosting platform, our website hosting and content delivery provider, and Ko-fi for voluntary contributions. Your use of a third-party service, such as making a Ko-fi contribution, is governed by that provider's own terms and privacy policy.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if your use creates risk or legal exposure for us or other users, or if we are required to do so by law. Sections covering your content, disclaimers, limitation of liability, and governing law survive termination.

9. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that your data will never be lost. Keep your own copies of any writing that matters to you. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, Draft Tally and anyone working on its behalf will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of the Service. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or fifty US dollars.

11. Indemnity

You agree to indemnify and hold harmless Draft Tally from claims, damages, and reasonable legal costs arising out of your content, your use of the Service, or your breach of these Terms, except to the extent the claim results from our own wrongdoing.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and for material changes we will provide additional notice, such as an in-app message or an email. Continuing to use the Service after an update means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Texas, except that either party may seek injunctive relief in any court of competent jurisdiction. Nothing here removes consumer protections you are entitled to under the mandatory law of your country of residence.
